FAMILY PHOTOGRAPHY TERMS & CONDITIONS

1. PAYMENT

For normal photoshoots, a non-refundable booking fee of £60 is due at the time of booking in order to secure the photoshoot. No photoshoot is confirmed until the booking fee has been received. The balance of the fee is due 14 days prior to the photoshoot. Non-receipt of your balance may lead to the cancellation of the session with no return of any monies paid to date. Fees are only refundable in accordance with the Cancellation, Rescheduling and Refund Policy set out below.  

For mini shoots, the full fee must be paid at the time of booking (or within 24 hours where payment is being made by bank transfer). 

You have the choice of paying by bank transfer or by PayPal, paying by Paypal may incur a small additional charge to cover the costs charged by Paypal.

You may choose to upgrade your session or buy additional products (such as printed images and artwork), you are under no obligation to do so. Payment for these items must be made at the time of ordering,  no part of your order will be delivered unless and until we receive payment in full of all amounts due.

Unless otherwise stated all fees that are quoted are inclusive of VAT if applicable.

2. THE SESSION

Please arrive for your session ready to start promptly. Late arrival may reduce the time available for a session.

A responsible adult must accompany all children at all times. The responsible adult is responsible for your child at all times during the session. The nature of photo shoots means there is equipment (for example light stands) and other hazards (for example tree branches) that could present a risk to a child. The responsible adult must supervise the child to ensure their safety at all times. 

The responsible adult shall also assist and cooperate with the photographer in obtaining the desired photographs, including but not limited to encouraging children to pose for photographs at the Photographer’s direction. The Photographer shall not be responsible for photographs not taken as a result of the failure to provide reasonable assistance or cooperation, or the children not following appropriate direction.  

Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. The photographer will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

Lyndsey Abercromby Photography shall be granted creative and artistic license in relation to the choice of locations and poses used. If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of images meeting normal artistic standards, the Photographer may, following conversation with the client, elect to use an alternate location or to reschedule the session.

You must not take any photographs during the photoshoot without first obtaining permission from the Photographer. 

3. AFTER THE SESSION

The photographer will review all images from the photoshoot and edit those that are in keeping with the highest quality and style of the photographer’s work. The photographer reserves the right to withhold any images not in keeping with her standards.

All image sizes are approximate. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record on film or in print the exact colour as seen by the human eye. You will get a variety of colour and black and white images. There is no right to reject on the basis of style or composition.

Reasonable retouching of images is included in the package. Where a client requests retouching in excess of this, the Photographer will notify the Client of any additional charges associated with the additional retouching work in advance of the work being undertaken. We may need to refer certain retouching services to third-party partners and will advise of the costs upon request.  Please note that I do not provide raw images.

We aim to have your images available to view within 28 days of the photoshoot, unless otherwise advised. You will be notified that your images are available to be viewed, and sent a link to your password protected online gallery which will contain low-resolution watermarked proofs of your images. It is acknowledged that not all Photographs taken during the photoshoot will be included. The number of images in a gallery will vary from session to session. 

Your online gallery will be available for 14 days, unless otherwise agreed. We reserve the right to delete your gallery if you do not select any images during this time. We reserve the right to charge a fee of £25 to reopen a gallery. Once you have made your selection, digital images will be supplied via download link. 

Delivery time for any additional items ordered will be discussed at the time of ordering. The Photographer must be notified in writing within 5 working days of the Client receiving their order of any error, shortage or damage as mistakes cannot be rectified after this period.

If you order an artwork product, a proofed layout of the product, together with any options available to you, will be submitted to you for approval before the product is printed. You may request reasonable changes as part of the approval process, but some changes may be subject to additional charges.  We will advise you if additional charges apply.  We will not submit any product for printing unless and until the proofed layout has been approved by you and you have confirmed your options (where available).  You will be liable for any costs associated with any changes requested after you have approved the proofed layout.

It is your responsibility to ensure the safe storage of images. While every effort is made to back up the photographer cannot guarantee that the images will still be available should they wish to place further orders in the future. The cost to re-open a gallery (if available) is £25, this cost will be deducted from the cost of any order placed.

Lyndsey Abercromby Photography adjusts their price list periodically, and future orders shall be charged at the prices in effect at the time when the order is placed. Reorders shall be treated as an extension of this contract.

4. COPYRIGHT & PRINT RELEASE

Lyndsey Abercromby Photography retains the copyright to all images.

All digital images included with or bought in addition to a package are provided with permission for you to use the images for personal use. This includes displaying the images on social media and using the images to make products for personal use, such as prints, calendars, mugs, gifts, etc.

The print release does not allow you to use the images for commercial or editorial use, to edit or alter the images, or enter them into any competition without the photographer’s permission. Lyndsey Abercromby Photography cannot accept any responsibility or liability for colour balance or quality of any images reproduced by Third Party Printers such as high street photo processing shops

When sharing images, images must be presented as originally delivered; this means no additional editing or ‘filters’ may be used on the image. I appreciate you tagging my facebook / Instagram account when sharing images, this helps build awareness of my business (and I love to see people proud of images I’ve created for them!).

5. CANCELLATION

Should you wish to cancel the photoshoot for any reason you have 14 days from making the booking to do this, this is called the cooling off period. However, once the photoshoot has started you cannot change your mind, even if we are still in the cooling off period. 

If you want to cancel more than 14 days after you made your booking and more than 14 days before the photoshoot, the balance of your photoshoot will be refunded.

If you wish to cancel less than 14 days before your photoshoot, your booking fee and any payments made by this point are non-refundable. In the event that you cannot make your session, please contact me as soon as possible. Where possible, I will attempt to accommodate your session at an alternative date / time, or you may re-sell your photoshoot. This is not guaranteed and the more warning you can give me the more likely it is that something can be arranged. Any cake smashes postponed with less than 7 days notice will be charged for a replacement cake (£35). 

If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, act of God, or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. The Photographer(s) shall not be liable for any indirect or consequential loss or any additional costs incurred by the Client(s) as a result of the rearrangement of the session. If a reschedule is unable to be agreed upon, the Photographer shall return the booking and any further payments received and shall have no further liability. In rare circumstances, the photographer may need to rearrange or cancel a photoshoot. Where a reschedule is unable to be agreed upon the Photographer shall return the booking and any further payments received and shall have no further liability.

If we consider there are extenuating circumstances, for example, inappropriate behaviour or a model is ill, we may terminate a photoshoot. We are not required to reschedule the photoshoot or refund any payment in this circumstance.  

Any printed photographs and artwork products are personalised for you so you do not have any right to cancel your order. We are unable to refund or offer an exchange if you change your mind. This doesn’t affect your statutory rights.

6. LIMITATION OF LIABILITY

In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the chosen package. Neither party shall be liable for indirect or consequential loss.

 

7. PRIVACY

As a photography business, I rely on being able to use images to market my business. This may include, but is not limited to, use within my place of business, on my website (www.lyndseyabercromby.co.uk), on social media (e.g. Facebook, Instagram, Pinterest), blogging, or portfolio usage for prospective clients.

I also participate in the ongoing development of my skills and knowledge. This may include, but is not limited to, mentoring reviews, contest entry, image critiques.

I believe in respecting your rights and privacy and therefore allow you to choose how much exposure your photographs receive. You will be asked to provide consent to images from your photoshoot being used for the above purposes before they are shared. 

8. GIFT VOUCHERS

Gift vouchers cannot be refunded or exchanged for cash, they are non-transferable. Gift vouchers must be paid for in full at time of purchase.

Any change will be given in the form of gift vouchers, not cash.
